References to “the App” refer to the use of the software as a service application which is found in the the password protected section of app.myhrtoolkit.com/user_portal (“the App”).

References to “we”, “us” or “our” are references to Myhrtoolkit Limited of Edmund House, 233 Edmund Road, Sheffield S2 4EL

This User Guidance (together with our Privacy statement (users) and any other documents referred to on it) sets out the basis on which any personal data is processed.

By using the App you are accepting and consenting to the practices described in this policy.

Use of this site

This guidance concerns your use of this Site. By accessing the App you agree to adhere to these rules. We reserve the right to change this document at any time without notice by updating this User Guidance and your continued access to or use of this Site will constitute your acceptance of any such changes.

Password

You must keep your password secure at all times. If you believe that your password may have fallen into the hands of a third party, you should immediately inform your organisation’s Controller so that your password can be changed. If you choose to change your own password you should follow the security guidance on our website.

Use of Site

We may in our sole discretion terminate your access to or use of the App for any reason, including without limitation where we believe that you have not acted in accordance with the guidance provided.

We reserve the right to amend or alter any part of the App at any time and without prior notice. We shall not be liable to you in any way whatsoever in respect of any such amendment or alteration.

It is your responsibility to review this policy when you log in to ensure that you are aware of any updates.

The entire content of this Site (excluding personal data related to users) is subject to copyright with all rights reserved to us. You may not download (all or in part), copy, transmit or modify the App or any part of it without our prior permission. However, you may print out part or all of the App for your own personal use.

The contents and technology or processes contained or described in the App may be subject to other intellectual property rights reserved by us or by other third parties (and no licence is granted in respect thereof).

Security

We have an obligation under the General Data Protection Regulation to ensure the security of the processing of your data and to that end we make commercially reasonable efforts to secure your data. This forms part of our contract with your employer. Subject to that, we will accept no liability in any event including (without limitation) negligence for any damages or loss of any kind, including (without limitation) direct, indirect, incidental, special or consequential damages, expenses or losses arising out of, or in connection with any breach of security by any third party or by loss of data or in the event that such information is inadvertently released by us or accessed by third parties without our consent.

No Warranty

As we are a data processor and merely provide your employer with the ability to process your personal data, we have no liability whatsoever in respect of any information posted on the App by you or any other user.

We do not warrant that the functions or materials contained in or accessible from the App will be error free, uninterrupted, or that the App or the server that makes it available are virus or bug free.

No Liability

Subject to the requirements of statute, including the General Data Protection Regulation, we will accept no liability in any event including (without limitation) negligence for any damages or loss of any kind, including (without limitation) direct, indirect, incidental, special or consequential damages, expenses or losses arising out of, or in connection with your use or inability to use the App, or in connection with any error, omission, defect, computer virus or system failure, or loss of any profit, goodwill or reputation, even if expressly advised of the possibility of such loss or damages, arising out of or in connection with the access of, use of, performance of, browsing in or linking to other sites from the App.

Any such liability is excluded to the fullest extent permitted by law. Please note that this exclusion does not exclude our liability for death or personal injury caused by our negligence.

Governing Law

English law governs this guidance and you agree that the English Courts shall have exclusive jurisdiction to determine any matter or dispute in connection with or arising out of the App and this guidance.
